I suppose (if she actually has a survey that shows the fence on her property) she could file a lien or something similar that would encumber the title and prevent the sale....

of course this also assumes that an atty would take the case, and would not use common sense with her to say that even if the fence is an inch or two over the line, what is the value in filing the lien.

- Your definitely taking the high road. I'm in an urban neighborhood with a lot of share fence lines (small yards) . Usually the fence owner puts the boards on their side for the aesthetic.
